TERMS AND CONDITIONS

1. General
The Dutch Barn is a fitness and wellbeing centre offering classes, workshops, and treatment room services. References to “we”, “us”, or “our” mean The Dutch Barn. “You” or “your” means the client, customer, or participant.
Independent therapists operate from our treatment rooms. They are responsible for their own qualifications, professional standards, and insurance.
 
2. Health & Safety
Participation in classes, workshops, or treatments is at your own risk. You confirm that you are fit to take part in activities you book.
If you are pregnant, have an injury, or a medical condition, you must notify the instructor or therapist before participation.
Do not attend if you have a contagious illness or condition that could pose a risk to others.
We are not liable for injuries except where caused by our negligence.
 
3. Bookings & Cancellations
Classes must be pre-booked.
•    Cancellations made more than 12 hours before the start time will be credited back to your account.
•    Cancellations made within 12 hours or no-shows will result in the loss of the class credit, drop-in pass, or guest pass used to book.
Class Packs
•    One (1) Class Pack: valid for 1 month from date of purchase.
•    Five (5) Class Pack: valid for 2 months from date of purchase.
•    Ten (10) Class Pack: valid for 6 months from date of purchase.
•    Drop-in passes and guest passes: valid for 1 month from date of purchase.
Any class pass(es) not used within the validity period will be forfeited. Packs are not shareable, transferable, or extendable, and are non-refundable after first use.
Late cancellation and no-show policies (as above) apply to all class packs, drop-in classes, and guest passes.
4. Treatments & Workshops
Treatments and workshops held in our treatment rooms are booked directly with the independent professional running the service. Each practitioner sets their own cancellation and refund policy, which applies to their bookings. The Dutch Barn is not responsible for the management of bookings, payments, or cancellations made directly with individual therapists.
Some workshops are run by external professionals who operate independently.
These sessions will have their own booking, payment, and cancellation policies, which will be clearly stated at the time of booking.
 
5. Gift Cards, Promotions & Discount Codes
•    Promotional offers, gift cards, and discount codes are valid only for the period stated and are non-transferable.
•    Only one discount or promotion may be used per booking unless otherwise specified.
•    Offers have no cash value and cannot be exchanged.
 
6. Conduct & Behaviour
We expect all clients to act respectfully towards staff, therapists, and other clients.
Unsafe, abusive, or disruptive behaviour may result in removal and refusal of future bookings.
Use of mobile phones, photography, or recording is not permitted in private areas (treatment rooms, showers, changing spaces).
•    Showers are available for use until 5 pm only. After this time, access is restricted to maintain building cleanliness and safety for evening sessions.
 
7. Car Park & Facilities
Free onsite parking is available during your booking. Vehicles and belongings are left at the owner’s risk.
Shared facilities (lobby, toilets, showers) must be used respectfully and left tidy.
Personal property should not be left unattended.
We accept no liability for loss or damage.
 
8. Data Protection (GDPR)
We collect and process your data in line with UK GDPR and the Data Protection Act 2018.
Data collected may include your name, contact details, booking history, and health declarations.
Your data is used only for booking management, health & safety, and legal obligations.
We will not share your information with third parties without consent, except where legally required.
You may request access, correction, or deletion of your data at any time by contacting us at [hello@dbarn.co.uk].
 
9. Liability & Waiver
You accept that exercise and treatments carry inherent risks, including but not limited to minor injuries, strains, or more serious conditions.
By attending, you agree to assume responsibility for your own health and safety.
Nothing in these Terms excludes liability for death or personal injury caused by our negligence.

 
10. Health Commitment Statement
Our Commitment to You:
•    We will respect your personal decisions and allow you to determine what level of activity you are comfortable with.
•    We will ensure our facilities and equipment are maintained in a safe condition for you to use.
•    We will make reasonable efforts to ensure our staff and instructors are appropriately qualified to recognised UK fitness and wellbeing standards.
•    If you inform us of a disability or condition that places you at a substantial disadvantage in accessing our services, we will consider what reasonable adjustments can be made.
Your Commitment to Us:
•    You should not exercise or undertake treatments beyond your own abilities.
•    If you know or suspect you have a medical condition that may affect your ability to safely take part, you must seek medical advice before attending and follow that advice.
•    You are responsible for making yourself aware of all rules, safety instructions, and any warning notices.
•    You should immediately stop and inform us if you feel ill or unsafe while participating.
•    If you have a disability, you must follow reasonable instructions to ensure your safety and that of others.
By attending any class, workshop, or event at The Dutch Barn, you confirm that:
•    You have completed and submitted our Health & Safety Waiver Form (sent prior to your first session by email).
•    You are voluntarily participating in physical activity and accept that such participation carries inherent risks.
•    You take full responsibility for your own health and wellbeing and will notify your instructor of any injuries, health conditions, or changes that may affect your participation.
•    You agree to release The Dutch Barn, its owners, instructors, and contractors from any and all liability for injury, loss, or damage arising from participation, except where caused by negligence.
If you have any medical concerns, you should consult a GP before starting any new form of exercise.
 
11. Photography & Marketing
We occasionally capture photography or video for marketing purposes.
You will be notified if this takes place during your class or event.
Please advise staff if you prefer not to appear.
 
12. Changes to Terms
We may update these Terms at any time. The latest version will be published on our website.
 
13. Governing Law
These Terms are governed by the laws of England and Wales.
Disputes shall be subject to the exclusive jurisdiction of the English courts.
